These Terms of Use ("Terms") govern your access to and use of the PouchOut mobile application ("PouchOut" or the "App"), the pouchoutapp.com website (the "Website"), and related services provided by APP STAR FAMILY PTE. LTD. ("we", "us", or "our").
By accessing or using PouchOut or the Website, you agree to these Terms.
If you do not agree to these Terms, please do not use PouchOut or the Website.
PouchOut is a companion application designed to help users track and reduce nicotine pouch use, log cravings and triggers, and monitor progress toward personal quitting goals.
PouchOut is not a medical device, and it does not provide medical advice, diagnosis, or treatment. PouchOut is a self-directed tracking and motivation tool.
Features may be added, modified, restricted, or removed over time.
Content within PouchOut and on the Website, including blog articles, is provided for general informational purposes only and does not constitute medical advice.
Always consult a qualified healthcare professional before making decisions about your health, including decisions about nicotine use, quitting methods, or any symptoms you experience.
If you are experiencing a medical emergency, contact emergency services or poison control immediately rather than relying on PouchOut or this Website.
You must be at least 13 years old to use PouchOut.
If you are under the age of majority where you live, you should use PouchOut only with the permission of a parent or legal guardian.
PouchOut is provided for personal, non-commercial use unless we expressly agree otherwise in writing. You agree not to:
We may restrict or terminate access where we reasonably believe PouchOut or its supporting services are being abused.
If you grant permission, PouchOut may read heart rate data from Apple's HealthKit framework to help correlate your nicotine use with physical indicators. This data is processed on your device and is not transmitted to our servers.
You can review or revoke HealthKit permissions at any time in your device's Settings app, under Privacy & Security, then Health.
PouchOut may offer free and paid features, subscriptions, introductory offers, trials, or one-time purchases.
Purchases made through the iOS App Store are processed by Apple and are subject to Apple's applicable terms and conditions.
We do not directly process or store your payment-card information.
Unless otherwise stated by Apple or required by applicable law, subscriptions automatically renew until cancelled.
You can manage or cancel subscriptions through your Apple account subscription settings.
Refund requests for App Store purchases are generally handled by Apple and are subject to Apple's refund policies.
PouchOut uses RevenueCat to help determine subscription and entitlement status.
If you are a consumer located in the European Economic Area or the United Kingdom, applicable law may give you a statutory right to withdraw from a purchase of digital content within 14 days without giving a reason, unless you have expressly consented to immediate access to that content and acknowledged that you lose this withdrawal right once performance begins.
Where you make a purchase through the Apple App Store, Apple's own purchase flow may present this consent and acknowledgment to you directly, and Apple's refund and cancellation policies may also apply to your purchase.
Nothing in these Terms limits any statutory right you have as a consumer under the mandatory law of your country of residence.
PouchOut depends on third-party platforms and services, including services provided by Apple, RevenueCat, and website analytics providers.
We do not control these third-party services, and their availability, functionality, and terms may change independently of us.
The PouchOut application, Website, branding, visual design, software, original graphics, interfaces, features, and other original material created by us are owned by or licensed to APP STAR FAMILY PTE. LTD. and are protected by applicable intellectual property laws.
These Terms do not transfer ownership of PouchOut or any of our intellectual property to you.
To the maximum extent permitted by applicable law, PouchOut and the Website are provided on an "as is" and "as available" basis.
We do not warrant that PouchOut will always be available, uninterrupted, secure, or error-free, or that it will achieve any particular health or quitting outcome for you.
Nothing in these Terms excludes warranties or rights that cannot lawfully be excluded under applicable consumer-protection laws.
To the maximum extent permitted by applicable law, APP STAR FAMILY PTE. LTD. and its directors, officers, employees, contractors, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or relating to your use of or inability to use PouchOut or the Website.
Nothing in these Terms excludes or limits liability where doing so would be prohibited by applicable law, including liability that cannot be excluded under applicable consumer-protection legislation.
You may stop using PouchOut at any time.
We may suspend or terminate access to PouchOut or particular features where reasonably necessary because of a material violation of these Terms, fraudulent or unlawful activity, abuse of our systems, security risks, or legal requirements.
Your use of PouchOut is also subject to our Privacy Policy, which explains how information may be collected, processed, and shared in connection with the App and related services.
We may update these Terms from time to time to reflect changes to PouchOut, third-party services, legal requirements, or other operational needs.
When we make changes, we will update the "Last updated" date at the top of these Terms.
Your continued use of PouchOut after updated Terms become effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.
These Terms are governed by the laws of Singapore, without regard to conflict-of-law principles, except where mandatory consumer-protection laws in your country of residence provide otherwise.
